Providing advice and counsel to employers. With an emphasis on avoiding litigation and improving business operations, Winthrop & Weinstine counsels employers on employment law issues. We answer the question, "Can I do this?" and provide advice about whether you should or should not take a particular course of action. Our attorneys work closely with human resources managers and in-house counsel of our larger clients and with owners and executives for other clients. We have the experience and knowledge to counsel employers in many areas including the following:

  • Compliance with federal and state employment laws: We counsel clients on compliance with Title VII, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Family and Medical Leave Act, the Minnesota Human Rights Act, the Fair Labor Standards Act and state law regarding issues such as parental leave, access to personnel files, and drug testing.

  • Accommodation of disabled employees: We help employers navigate the maze of workers compensation laws, the Americans with Disabilities Act, and the Family and Medical Leave Act.
  • Response to discrimination charges: We represent our clients against charges filed with federal or state agencies, such as the Equal Employment Opportunity Commission or the Minnesota Department of Human Rights.
  • Drug-testing programs: We assist our clients with both design and implementation.
  • Information protection strategies: We help clients develop strategies dealing with protecting confidential information and customer relationships, and drafting of non-compete, non-solicitation and confidentiality agreements.
  • Wage and hour issues:We advise on issues such as establishing and maintaining the exempt and non-exempt status of employees.
  • Reductions in force and reorganizations: We assist in analyzing the potential impact on protected groups, and strategies to avoid age discrimination and other discrimination claims.
  • Employee terminations: Our guidance includes what to say in a termination meeting.
